  93. ~~~~~~~~~~~
  94. 'Software' or 'Program' means the ChaoSoft software product StepUp'96,
  95. including both the software and the associated documentation and other
  96. materials;

  98. 'Evaluation Copy' means a copy of the Program you obtained from us or
  99. other source for evaluation purposes and which is described as
  100. "Unregistered" in the 'About' screen. An Evaluation Copy may be converted
  101. to the Licensed Copy by supplying a name of a registered user or
  102. institution and a correct Registration Code, which may be obtained from
  103. ChaoSoft or its authorized dealer(s).
  104.  
  105. 'Licensed Copy' means a copy of the Program registered with ChaoSoft or
  106. with its authorized dealer, and which is described as "Registered to:
  107. <user name>" in the 'About' screen. A Licensed Copy converts itself into
  108. an Evaluation Copy when it is copied to another disk or computer, or when
  109. the registration information is erased.
  110.  
  111. 'Registration Package' means all the materials you are obtaining from us
  112. or our authorized dealer after sending us your registration fee. In
  113. particular, Registration Package contains your personal Registration
  114. Code, allowing you to remove the registration reminder message and put
  115. your name in the 'About' screen.

  117. 'we' or 'us' means ChaoSoft, a company produced this software
  118.  
  119. and
  120.  
  121. 'you' means the end user or distributor of the Software.

  123. Legal Agreement.

  125. This is a legal agreement between you and ChaoSoft. By using or
  126. distributing the software you are agreeing to be bound by the terms of

  132. the terms of this agreement. The software is in "use" on a computer when

  137. The software is NOT a public domain or free program. It is owned by
  138. ChaoSoft and is protected by United States copyright laws and
  139. international treaty provisions. Therefore, you must treat the Software
  140. like any other copyrighted material except that a limited right to make

  142. is granted to you. You may not copy any written or printed materials
  143. from your Registration Package and you may not rent or lease a Licensed
  144. Copy of the Software.

  146. TRIAL USE LICENSE

  148. ChaoSoft grants to you a limited license to use an Evaluation Copy of
  149. this software for evaluation purposes for a period not to exceed 14 days.

  151. This period may be not a contiguous sequence of days. However, you should
  152. count a day as an evaluation day if you used the Program during that day
  153. at least once. The purpose of this evaluation period is to allow you to
  154. determine whether the program meets your needs before purchasing it.

  156. Once the evaluation period has ended, you MUST either purchase a license
  157. for continued use of the program, or stop using it.  Use of an Evaluation
  158. Copy beyond the end of the evaluation period without registering it is in
  159. violation of federal copyright laws.

  161. If you have sent out your registration fee, you may continue to use your
  162. Evaluation Copy beyond the end of the evaluation period until your
  163. Registration Package arrives.

  165. Obtaining a license for continued use of the Program.

  168. To obtain a license for continued use of the Software, you should send
  169. your name, address, and correct amount of registration fee to our

  171. documentation to the Software.  After getting your Registration Package,
  172. containing the Registration Code assigned to you, you may use that code
  173. to convert your Evaluation Copy of the Software into the Licensed one.

  175. You agree to keep the Registration Code for your own use only and
  176. not share it with anybody else.
  177.  
  178. LICENSED COPY USE LICENSE

  180. ChaoSoft grants to you the right to use a Licensed Copy of the software,
  181. if you have registered (purchased a license for continued use) it with us
  182. or with our authorized dealer.

  184. You may install a Licensed Copy of the software on more than one computer
  185. (for example, a desktop system and a portable notebook), provided that
  186. you are the only user of those computers and there is no possibility to
  187. use the Licensed Copy by anybody else.
  188.  
  189. You may not network a Licensed Copy or otherwise use it on more than one
  190. computer or computer terminal at the same time unless you have purchased
  191. a site license.
  192.  
  193. If the Licensed Copy you are using is registered to some other name, you
  194. MUST either unregister it by removing the registration information, or
  195. stop using it. Use of a Licensed Copy, registered to anybody else except
  196. you (or, for site license arrangements, to your organization), is in
  197. violation of federal copyright laws.
  198.  
  199. Multi-User and Network Use.

  201. If you have registered the Software for use by multiple users,  you agree
  202. not to use the Program on more computers than the number specified in
  203. your site license. You may install the Program on computers attached to a
  204. network, or remove it from one computer and install it on a different
  205. one, provided there is NO POSSIBILITY that your copy will be installed or
  206. used on more computers than it is licensed for.  If you have a network,
  207. you don't need to include every computer attached to the network in your
  208. license, but you must include every computer on which the Program is
  209. installed or used, regardless of whether the user of the computer happens
  210. to know that the Program is in use on their system.  If you have single
  211. computers which allow multiple users to use the Program simultaneously,
  212. you must count each keyboard or terminal separately when determining how
  213. many computers are using the Program.

  215. LIMITED DISTRIBUTION LICENSE

  233.    them to others for any kind of compensation or fee (small shipping and
  234.    handling fees are acceptable), unless you are an ASP approved Vendor

  263. and automatic termination of this license.

  265. LIMITED WARRANTY

  267. The following limited warranty applies to Licensed Copies of the Program.
  268. This warranty does NOT apply to Evaluation Copies of the Program.

  270. Satisfaction Guarantee.  If you are dissatisfied with any product you buy
  271. from us under this Agreement for any reason, you may return it at any
  272. time up to 30 days after purchase and we will give you a refund. Refunds
  273. will be based on the price you paid, with shipping costs excluded.  You
  274. must contact us before returning any product for a refund. This
  275. satisfaction guarantee does not apply to multi-system licenses for more
  276. than 10 computers, or to purchases of more than 10 individual copies at a
  277. time.

  279. Physical Defects.  We pledge that the disks, if any, and any printed
  280. material we send you will arrive free of physical defects which interfere
  281. with normal use. If you find such a defect and report it to us within 30
  282. days after you get your Reggistered Package, we agree to replace the
  283. defective item(s) at no charge to you as long as the defect was not
  284. caused by misuse or abuse.

  286. Bugs and Program Errors.  We don't promise that the Software will be free
  287. of bugs or program errors, and you agree that bugs or program errors will
  288. not be considered as "physical defects" in the program. We agree that if
  289. you report a program error or bug to us, we will use our best efforts to
  290. correct it.

  292. DISCLAIMER OF WARRANTY

  334. competent jurisdiction located in Augusta, Maine. The parties hereby
  335. consent to in personal jurisdiction of said courts.
